Pursuant to FRCP Rule 23, ourt conditionally certifies the class for settlement purposes only. Court appoints Plaintif f as Class Representative of the Settlement Class. Court appoints Joshua B. Swigart, Abbas Kazerounian, and Todd M. Friedman as Class Counsel to represent the Settlement Class. Court preliminarily approves the Settlement Agreement and the terms and c onditions of the settlement, subject to further consideration at the Fairness Hearing. Fairness Hearing set for 11/7/2016 10:30 AM in Courtroom 4B before Judge Cynthia Bashant. Any motion in support of the Settlement and any motion for award of att ys' fees and costs or Plaintiff's service award, must be filed by 8/15/2016. Any opposition must be filed no later than 14 days after the motion is filed and any reply must be filed no later than 28 days after the motion is filed.
