The Court will not order that Dr. Madisetti be barred from any consulting work with respect to wireless communications for the duration of this litigation and Defendant's request to take an additional deposition of Dr. Madisetti and conduct discovery from Ericsson is DENIED as is Defendant's request for sanctions and the costs that Defendant incurred in bringing the instant motion. Given all of the circumstances underlying the motion, the Court finds that an award of expenses would be unjust and therefore also DENIES Plaintiffs' request to recover their costs in opposing Defendant's motion.
