ORDER granting defendant's 12 Motion to Dismiss, plaintiff's claims are dismissed with prejudice; granting defendant's 13 Motion to declare Thomas a vexatious litigant. Accordingly, Thomas is enjoined from filing any future civil action against BOA that pertains to the foreclosure on his home without first seeking the approval of the Court.
