ORDER granting 2 Motion for Leave to Proceed in forma pauperis, and sua sponte dismissing complaint without prejudice for failing to state a claim pursuant to 28 U.S.C. § 1915(e)(2)(B). Plaintiff is GRANTED forty five (45) days leave from the date this Order is filed in which to reopen the case by filing a Amended Complaint. Should Plaintiff fail to file a Amended Complaint within the time provided, this civil action shall remain closed and case shall remain dismissed without prejudice based on Plaintiff's failure to state a claim upon which relief can be granted pursuant to 28 U.S.C. § 1915(e)(2)(B).
