Additionally, the Court denies the MTD with respect to FootBalance's claim for direct infringement against the individual defendants prior to the incorporation of ZGI. FootBalance may file an amended complaint within fourteen (14) days of the date this Order is electronically docketed. Failure to file an amended complaint in this time may result in dismissal with prejudice of FootBalance's alter ego direct infringement claims as to the individual defendants.
