ORDER granting 26 Motion for Preliminary Approval of Class Action Settlement. Court conditionally certifies the class for settlement purposes only. Court appoints Plaintiff Mary Capps as Class Representative of the Class. Court appoints Babak Semn ar and Jared M. Harman of Semnar & Harman, LLP as Class Counsel to represent the Class. Court preliminarily approves the Settlement Agreement and the terms and conditions, subject to further consideration at the Fainess Hearing. Fairness Hearing set for 3/13/2017 10:30 AM in Courtroom 4B before Judge Cynthia Bashant. Any motion in support of the Settlement, and any motion for attys' fees and costs or Pla's service award, must be filed by 2/13/2017. Any opposition must be filed no late r than 14 days after the motion is filed. Any reply must be filed no later than 21 days after the motion is filed. Court appoints First Class, Inc. as the Claims Administrator for the Settlement. The costs and expenses related to claims adminsitration shall be paid by Defendants and shall not exceed $4,000, in accordance with the provisions of teh settlement Agreement.
