ORDER Granting 2 Motion for Leave to Proceed in forma pauperis and Dismissing Complaint for Failint to State a Claim: The Secretary of the CDCR, or his designee, shall collect from Plaintiffs prison trust account the $350 filing fee owed i n this case by collecting monthly payments from the account in an amount equal to twenty percent (20%) of the preceding months income and forward payments to the Clerk of the Court each time the amount in the account exceeds $10. The Cler k of the Court is directed to serve a copy of this Order on Jeffrey A. Beard, Secretary, California Department of Corrections and Rehabilitation. Plaintiff's Complaint is dismissed for failing to state a claim. the Court grants Plaintiff 45 days leave in which to re-open his case by filing an Amended Complaint.
