ORDER granting 34 Defendant's Motion to Dismiss; denying 34 Defendant's Motion to Strike. the Court orders as follows: (1) The Court DENIES Defendant's motion to strike Plaintiff's class definition; (2) GRANTS Defendant' ;s motion to dismiss; and (3) DENIES WITH PREJUDICE Plaintiff's cause of action for breach of implied warranty of fitness for a particular purpose. Plaintiff is granted fourteen (14) days from the date of this Order to file a third amended complaint correcting the deficiencies noted herein.
