ORDER granting in part and denying in part the City's 4 Motion to Dismiss. Specifically, the Court dismisses Plaintiff's first claim against the City without leave to amend but denies the City's request to dismiss Plaintiff's second claim. The Court grants Hay's 14 Motion to Dismiss. The Court dismisses Plaintiff's first claim against Hays with leave to amend and dismisses Plaintiff's second claim against Hays without leave to amend.
