The Court dismisses this civil action in its ent irety without prejudice based on Plaintiff's failure to state a claim upon which § 1983 relief can be granted pursuant to 28 U.S.C. § 1915(e)(2)(B) and §1915A(b), and his failure to prosecute pursuant to FED. R. CIV. P. 41(b) i n compliance with the Court's August 30, 2017 and November 16, 2017 Orders. The Court Grants Plaintiff forty-five (45) days leave in which to file an Amended Complaint which cures all the deficiencies of pleading described in this Order. Plaintiff is cautioned, however, that should he choose to file an Amended Complaint, it must be complete by itself, comply with Federal Rule of Civil Procedure 8(a), and that any claim not re-alleged will be considered waived. Watch Commander of the San Diego Central Jail, or his designee, is ordered to collect from plaintiff's trust acco unt the $350 filing fee owed in this case by garnishing monthly payments from his account in an amount equal to 20% of the preceding month income and forwarding those payments to the Clerk of the Court each time the amount in the accoun t exceeds $10 in accordance with 28 USC 1915(b)(2).
