Filing 16 ORDER DISMISSING Civil Action for Failing to State a Claim Pursuant to 28 U.S.C. § 1915(e)(2) and § 1915A(b) and for Failing to Prosecute in Compliance With Court Order Requiring Amendment. The Court dismisses this civil action in its ent irety without prejudice based on Plaintiff's failure to state a claim upon which § 1983 relief can be granted pursuant to 28 U.S.C. § 1915(e)(2)(B) and §1915A(b), and his failure to prosecute pursuant to FED. R. CIV. P. 41(b) i n compliance with the Court's August 30, 2017 and November 16, 2017 Orders. Watch Commander of the San Diego Central Jail, or his designee, is ordered to collect from plaintiff's trust acco unt the $350 filing fee owed in this case by garnishing monthly payments from his account in an amount equal to 20% of the preceding month income and forwarding those payments to the Clerk of the Court each time the amount in the accoun t exceeds $10 in accordance with 28 USC 1915(b)(2).
