Court dismisses without leave to amend Plaintiff's constitutional access to courts claim for failure to state a claim which relief may be granted pursuant to 28 USC 1915(e)(2)(B) and 1915A(b). Court dismisses with leave to amend Plaintiff's claim under Title II of the ADA for failure to state a claim upon which relief may be granted pursuant to 28 USC 1915(e)(2)(B) and 1915A(b). Court will grant Plaintiff 30 days from the date of this Order to file a Second Amend ed Complaint. If Plaintiff wishes to file a Second Amended Complaint, he must do so by 10/30/2017. If Plaintiff does not file a Second Amended Complaint by 10/30/2017, Court will issue instructions the Clerk to issue a summons as to the First Amended Complaint 8 .
