The Warden of the OMDC, or his designee, is ordered to collect from prison trust account the $350 balance of the filing fee owed in this case by collecting monthly payments from the trust account in an amount equal to 20% of the preceding month income credited to the account and forward payments to the Clerk of the Court each time the amount in the account exceeds $10 in accordance with 28 USC 1915(b)(2). Plainti ff has forty-five (45) days leave from the date of this Order in which to file an Amended Complaint which cures the deficiencies of pleading described in this Order. Court dismisses this action sua sponte without prejudice for failing to pay the $400 civil and administrative filing fee or to submit a motion to proceed IFP pursuant to 28 USC 1914(a) and 1915(a). Court grants Plaintiff forty-five (45) days leave from the date of this Order to re-open the case by: a) prepaying the entire $400 filing fee required by 28 USC 1914(a) in full; or, b) completing and filing a motion to proceed IFP that includes both the affidavit and the certified copies of his trust account statement for the 6-month period preceding the filing of his Complaint required by 28 USC 1915(a)(1)(2) and Civil Local Rule 3.2(b).
