Filing 6 ORDER: The Court grants the Motion to Proceed In Forma Pauperis (Dkt # 2 ). The Secretary CDCR, or his designee, is ordered to collect from Plaintiff's trust account the full $350 owed in monthly payments in an amount equal to 20% of the preceding month's income to the Clerk of the Court each time the amount in Plaintiff's account exceeds $10 in accordance with 28 USC 1915(b)(2). Plaintiff's Complaint is dismissed without leave to amend. The Motion for Extensi on of Time (Dkt # 3 ) is denied as moot. The Court certifies that an IFP appeal of this dismissal would not be taken in good faith. The Clerk of Court is directed to terminate this action, and close the file. Signed by Judge William Q.
