Filing 7 ORDER of USCA as to #4 Notice of Appeal to the 9th Circuit filed by Robert Hatcher. On April 22, 2019, the USDC dismissed appellant's complaint for failure to pay the USDC fees or file a motion to proceed in forma pauperis. The USDC's April 22, 2019 order permitted appellant leave to file a motion to proceed in forma pauperis no later than June 6, 2019. On June 10, 2019, appellant filed a motion to proceed in forma pauperis in the USDC, dated June 4, 2019. Appellant also filed a notice of appeal, resulting in the opening of this appeal No. 19-55668. A review of the record suggests that the USCA may lack jurisdiction over the appeal because the USDC's order dismissing appellant's complaint with leave to file a motion to proceed in forma pauperis may not be a final appealable order. Within 21 days after the date of this order, appellant shall move for voluntary dismissal of the appeal or show cause why it should not be dismissed for lack of jurisdiction. If appellant does not comply with this order, the Clerk shall dismiss this appeal pursuant to Ninth Circuit Rule 42-1. Briefing is suspended pending further order of the USCA. (akr) |
