ORDER TRANSFERRING ACTION TO THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF CALIFORNIA by Judge Maame Ewusi-Mensah Frimpong. certified copy of the transfer order and docket sheet sent. On October 25, 2023, Plaintiff, a prisoner, filed a pro se Complaint pursuant to 42 U.S.C. 1983 and a Motion to Proceed In Forma Pauperis. (Dkt. Nos. 1-2.). A federal court may consider sua sponte the question of venue. Costlow v. Weeks, 790 F.2d 1486, 1488 (9th Cir. 1986). Here, a transfer is in the interest of justice because "Plaintiff's pro se incarcerated status militates in favor of transfer rather than dismissal of the action." Schotz v. Koch, 2009 WL 1505676, at *3 (D. Haw. May 28, 2009). Thus, this action is transferred to the United States District Court for the Southern District of California.
