February 24, 2016 Opinion or Order ORDER entered by Jeffrey R. Howard, Chief Appellate Judge; Juan R. Torruella, Appellate Judge and Rogeriee Thompson, Appellate Judge: Plaintiff-appellant has moved for appointed counsel pursuant to 42 U.S.C. 2000a-3(a). He has also moved for waiver of his filing fee pursuant to the same statute. He has requested abeyance in these proceedings pending a determination of his right to appointed counsel and waiver of his filing fee. The motion for abeyance is granted for a period of ninety days from the date of this order, while the motion for appointed counsel is considered by this court. It is ordered that no default or dismissal for non-payment of the filing fee will enter against plaintiff-appellant while these proceedings are held in abeyance. Plaintiff-appellant has moved to proceed in this appeal under the alias "John Doe." The motion is provisionally granted, while we intimate no view on whether it will ultimately be determined that plaintiff-appellant's identity should be sealed, and for how long, in this court or the district court. John Doe has further requested an order from this court that documents filed in the district court and in this appeal be subject to a seal, covering all material submitted in connection with this case that includes information that could directly or indirectly personally identify Plaintiff, including details of Plaintiff's disability, as well as the fact of Plaintiff's connection with this case. The request, as presented, is denied. It is ordered that documents with personal identifiers filed, or to be filed, in this court will remain under seal until further order of this court. The standard privacy protections in the governing court rules apply with full force. See Fed.R.Civ.P. Rule 5.2; U.S.D.C. D.Mass. Local Rule 5.3; Fed.R.App.P. Rule 25(a)(5); Rule 12, 1st Cir. Administrative Order Regarding Case Management/Electronic Case Files System ("CM/ECF"). John Doe has made a redaction motion directed at filings in the district court. The motion is not properly before this court in the first instance. It is denied, without prejudice to John Doe seeking relief in the first instance from the court receiving the filings. John Doe's motion for alternative access to the CM/ECF system is denied. While this case is being held in abeyance John Doe can use CM/ECF in the ordinary course if necessary. So ordered.
