ORDER entered: Attorneys Geoffrey G. Nathan and Neale A. Duffett have filed a motion seeking to withdraw as counsel for defendant-appellant Sean Trim. The motion is denied without prejudice to refiling accompanied by supporting documentation in compliance with Local Rule 46.6. Specifically, counsel must attach documentation, signed by defendant-appellant, indicating (1) whether defendant-appellant wishes to proceed pro se, (2) whether defendant-appellant has retained new counsel, or (3) whether defendant-appellant wishes to apply for appointed counsel. If defendant-appellant wishes to apply for appointed counsel, defendant-appellant must, with the assistance of Attorneys Nathan and Duffett , (a) file a financial affidavit and move to proceed in forma pauperis ("IFP") in the district court, and (b) provide this court with proof of filing. If the district court grants defendant-appellant IFP status, this court may appoint counsel under the guidelines of the Criminal Justice Act, 8 U.S.C. 3006A. If the district court denies the motion, defendant-appellant must file a motion to proceed IFP and financial affidavit in this court. Attorneys Nathan and Duffett are directed to Local Rule 46.6(a) providing that, An attorney who has represented a defendant in a criminal case in the district court will be responsible for representing the defendant on appeal . . . until the attorney is relieved of such duty by the court of appeals.
