ORDER entered by David J. Barron, Appellate Judge: We have considered the parties' responses to this court's show cause order questioning the timeliness of plaintiff's appeal. Because plaintiff's notice of appeal contains exhibits germane to the question of timeliness, we hold this appeal in abeyance and remand to the district court for the limited purpose of allowing the district court to determine whether the time for appeal should be extended under Fed. R. App. P. 4(a)(5) or reopened under Fed. R. App. P. 4(a)(6), on which we express no view. Defendant's motion to dismiss will be held in abeyance pending the district court's determination.
