Because plaintiff's notice of appeal contains exhibits germane to the question of timeliness, we hold this appeal in abeyance and remand to the district court for the limited purpose of allowing the district court to determine whether the time for appeal should be extended under Fed. R. App. P. 4(a)(5) or reopened under Fed. R. App. P. 4(a)(6), on which we express no view. Defendant's motion to dismiss will be held in abeyance pending the district court's determination.
