SUPPLEMENTAL record filed. Docket entries: 5 (Motion for Leave to Proceed in forma pauperis) and Text Order entered on May 29, 2019 by Judge McConnell, Jr. denying [7] Motion to Proceed in forma pauperis and certifying this appeal is not taken in good faith and any issues to be raised are frivolous. [19-1579] (GK) [Entered: 06/14/2019 09:01 AM] |
ORDER entered: Upon review of the record in this case, it does not appear that this court has jurisdiction to consider defendants-appellants Irwin Jacobowitz and Pearl H. Jacobowitz's appeal from the Remand Order entered on May 14, 2019 or from the Order denying reconsideration entered on May 29, 2019 in No. 1:19-cv-00276-JJM-PAS (D.R.I.). Further, in a text order entered on June 12, 2019, the district court certified pursuant to 28 U.S.C. 1915(a)(3) and Fed. R. App. P. 24(a)(3)(A) that the appeal is not taken in good faith. If appellants seek to challenge the district courts certification, defendants-appellants must file a motion pursuant to Fed. R. App. P. 24(a)(5) provided that appellants do so before July 15, 2019 . Accordingly, by July 15, 2019 , defendants-appellants are ordered either to move for voluntary dismissal of the appeal pursuant to Fed. R. App. P. 42 (b), or to show cause, in writing, why this appeal should not be dismissed and must either pay the $505 filing fee to the district court or file a motion in this court pursuant to Fed. R. App. P. 24(a)(5). Failure to comply with this order will lead to dismissal of this appeal for lack of diligent prosecution. [19-1579] (GB) [Entered: 06/13/2019 12:52 PM] |
A review of the district court docket indicates that a request to proceed in forma pauperis is pending for Appellants Irwin Jacobowitz and Pearl H. Jacobowitz. [19-1579] (MH) [Entered: 06/12/2019 03:08 PM] |
