ORDER entered by Sandra L. Lynch, Appellate Judge: Defendant-Appellants have filed a "Motion to Remand for Consideration of Post-Trial Motions," wherein they ask this Court to stay appeal 19-2125 and remand the case to the district court for consideration of timely post-trial motions filed pursuant to Fed. R. Civ. P. 50(b) and 59. Pursuant to Fed. R. App. P. 4(a)(4)(B)(i), the two notices of appeal filed in the district court will "become effective... when the order disposing of the last motion [from the list set out at Rule 4(a)(4)(A)] is entered." No remand to the district court is necessary or required. As such, both appeal 19-2125 and appeal 19-2109 will be held in abeyance until the district court disposes of the pending post-trial motions. Defendant-Appellants are directed to file a status report by January 15, 2020 and at thirtyday intervals thereafter, informing this Court of any action taken by the district court on the postjudgment motions. Further, Defendant-Appellants are directed to inform this Court when the district court has ruled and whether or not they intend to file a notice of appeal or amended notice of appeal from the district court's post-judgment order(s). See Fed. R. App. P. 4(a)(4)(B)(ii). While Appellants are encouraged to proceed with ordering all necessary transcripts to pursue this appeal, the time to file a transcript order form is enlarged to 10 days after the district court disposes of the above-mentioned motions. See Fed. R. App. P. 10(b)(1). [19-2109, 19-2125] (AL) [Entered: 12/16/2019 03:44 PM] |
