ORDER: In light of the supplemental record received from the United States District Court for the District of Massachusetts on October 7, 2020 and the district court's October 5, 2020 denial of plaintiff-appellant Philip R. Chomo's post-judgment motion for reconsideration, it is ordered that the deadline for plaintiff-appellant to file a transcript report/order form is hereby extended to and including October 19, 2020 . Failure to comply with this deadline may lead to dismissal of this appeal for lack of diligent prosecution. 1st Cir. R. 3.0(b). As per the court's September 8, 2020 order, plaintiff-appellant is also directed to inform this court whether or not he intends to file a notice of appeal or amended notice of appeal from the district court's post-judgment order on or before November 9, 2020 . ORDER: This court has docketed plaintiff-appellant Philip R. Chomo's notice of appeal from the order of dismissal entered on August 4, 2020 in No. 1:19-cv-11754-DJC (D. Mass.) as Appeal No. 20-1863. On August 27, 2020, plaintiff filed a motion for reconsideration (D.E. 39). Pursuant to Fed. R. App. P. 4(a)(4)(B)(i), the notice of appeal does not become effective until the district court disposes of the post-judgment motion. Therefore, appellant is directed to file a status report by October 8, 2020 and at thirty day intervals thereafter, informing this court of any action taken by the district court on the post-judgment motion. Further, the appellant is directed to inform this court whether or not he intends to file a notice of appeal or amended notice of appeal from the district court's post-judgment order. See Fed. R. App. P. 4(a)(4)(B)(ii). While appellant is encouraged to proceed with ordering all necessary transcripts to pursue this appeal, the time to file a transcript order form is enlarged to 10 days after the district court disposes of the above-mentioned motion. See Fed. R. App. P. 10(b)(1). Failure to comply with this order may lead to dismissal of this appeal for lack of diligent prosecution. 1st Cir. R. 3.0(b).
