SHOW CAUSE RESPONSE filed by Appellant E' Jai Bey to order for lack of jurisdiction [ # 6377529-2 ]. Certificate of service was not included. [20-1956] (CMP) [Entered: 11/04/2020 12:25 PM] |
ORDER entered: On September 30, 2020, plaintiff-appellant E'Jai Bey filed a pro se notice of appeal challenging the September 16, 2020 text order in No. 1:20-cv-00409-JJM (D.R.I.) that denied E'Jai Bey's motion to proceed without prepayment of fees or costs without prejudice to submission of an affidavit and a statement of assets by September 30, 2020. Upon review, this court appears to lack jurisdiction to consider this appeal as the challenged order does not appear to be a final judgment or an appealable interlocutory order. The appellant is ordered to move for voluntary dismissal of the appeal pursuant to Fed. R. App. P. 42(b), or to show cause, in writing, why this appeal should not be dismissed for lack of jurisdiction. The failure to take action by November 12, 2020 , will lead to dismissal of the appeal for lack of diligent prosecution. [20-1956] (MNH) [Entered: 10/28/2020 09:39 AM] |
