ORDER entered: Defendant-appellant Selene Finance LP filed a Notice of Appeal (no. 139) in Civil Action No. 16-cv-11719-MPK (D. Mass.) from the district court's October 16, 2020 order denying its motion for summary judgment (no. 132). Upon review of the record, it appears that the court may not have jurisdiction to consider the appeal because the challenged order is not a final judgment or an appealable interlocutory order. Additionally, we note that on January 4, 2021, the district court issued an order declining to certify the October 16, 2020 order for interlocutory appeal. The district court noted that the case involves disputed questions of fact, as opposed to a dispute of law, and defendant failed to establish exceptional circumstances that would warrant interlocutory certification under 28 U.S.C. 1292(b). Accordingly, defendant-appellant is ordered either to move for voluntary dismissal of the appeal pursuant to Fed. R. App. P. 42 (b), or to show cause, in writing, why this appeal should not be dismissed.
