Date Filed Document Text
January 27, 2021 Opinion or Order ORDER: Treating Attorney Ana Davide's request for removal from the service list as a motion to withdraw as counsel, the motion is denied without prejudice to refiling a renewed motion accompanied by supporting documentation in compliance with First Circuit Rule 46.6. Specifically, counsel must attach documentation, signed by the defendant, indicating (1) whether defendant wishes to proceed pro se, (2) whether defendant has retained new counsel, or (3) whether defendant wishes to apply for appointed counsel. If appellant wishes to apply for appointed counsel, appellant must, with the assistance of Attorney Ana Davide and/or Attorney Kehylis Yolanda Vazquez-Torres, (a) file a financial affidavit and move to proceed in forma pauperis ("IFP") in the district court, and (b) provide this court with proof of filing. If the district court grants appellant IFP status, this court may appoint counsel under the guidelines of the Criminal Justice Act, 8 U.S.C. 3006A. If the district court denies the motion, appellant must file a motion to proceed IFP and financial affidavit in this court. Attorney Davide is directed to Local Rule 46.6(a), providing that, an attorney who has represented a defendant in a criminal case in the district court will be responsible for representing the defendant on appeal, until the attorney is relieved of such duty by the court of appeals. Therefore, counsel is responsible for meeting all filing deadlines in this appeal until she is allowed to withdraw. Any renewed motion should be accompanied by proof of service on defendant-appellant. [21-1036] (CMP) [Entered: 01/27/2021 09:40 AM]
