| NOTICE of default and intent to dismiss issued. This appeal will be dismissed pursuant to Fed.R.App.P. 3(a) and 1st Cir. R. 45.0 for failure to prosecute unless the required PLRA forms are properly completed and filed with this office or the full filing fee is paid to the clerk of the district court by 10/14/2021. [21-1598] (KPC) [Entered: 09/30/2021 09:36 AM] |
ORDER entered: Pro se appellant Jon Bourassa has recently filed two transcript report order forms in this appeal. The first form, received on September 20, 2021, indicates both that transcripts are not necessary for this appeal and that he has already ordered transcripts for this appeal. That form is noncompliant because 1) it does not identify the court reporter from whom a transcript is requested (please note that a separate form must be completed for each court reporter from whom a transcript is requested); 2) it does not identify the proceeding(s) being requested by type of proceeding or date of proceeding; and 3) it does not indicate whether financial arrangements have been made with the court reporter. The second form, received on September 29, 2021, indicates transcripts are not necessary for this appeal and lists a court reporter, but that form is also noncompliant because 1) it does not identify the proceeding(s) being requested by type of proceeding or date of proceeding, 2) it does not indicate whether financial arrangements have been made with the court reporter, and 3) it is not signed by appellant. Accordingly, appellant is directed to either 1) file a motion for transcripts at government expense in the district court and provide this court with proof of filing, or 2) make satisfactory financial arrangements with the applicable court reporters and file compliant transcript order forms. Appellant's failure to comply with this order by October 22, 2021 , may lead to the issuance of a briefing schedule, if appropriate. In the event that the district court denies appellant's motion for transcripts at government expense, appellant is directed to refile his motion seeking transcripts at government expense in this court. See 28 U.S.C. 753(f). [21-1598] (ALW) [Entered: 09/29/2021 08:28 PM]
