ORDER entered.This court has docketed petitioner-appellant's appeal from the denial of his petition for writ of habeas corpus under 28 U.S.C. '2254. While petitioner did not file a timely notice of appeal from the September 1, 2021 denial, the motion for a certificate of appealability filed on September 10, 2021, indicated his intent to pursue an appeal. Therefore, the motion for a certificate of appealability is provisionally treated as a timely filed notice of appeal from the September 1, 2021 denial. See Fed. R. App. P. 3(c)(4). The case cannot go forward unless a certificate of appealability issues. 28 U.S.C. 2253. The district court issued a certificate of appealability on December 2, 2021. Accordingly, pursuant to Grant-Chase v. Commissioner , 145 F.3d 431 (1st Cir. 1998), this appeal can go forward on the issue for which the district court granted the certificate.
