JUDGMENT entered by David J. Barron, Chief Appellate Judge; Sandra L. Lynch, Appellate Judge and Rogeriee Thompson, Appellate Judge: Upon consideration of Intervenor Algonquin Gas Transmission LLC's motions to dismiss or transfer these petitions for review of orders of the Federal Energy Regulatory Commission; the petitioners' oppositions thereto; and Algonquin's replies, we conclude that this court lacks venue under the sole disputed venue provision of 15 U.S.C. 717r(b). See Federal Power Commission v. Texaco, Inc., 377 U.S. 33, 38-39 (1964) (ruling that for purposes of 717r(b), the natural-gas company is located in its State of incorporation"). Algonquin "is located" in Delaware, not in this circuit.Having jurisdiction over these petitions but not venue, we grant Algonquin's motions to the extent that they seek the transfer of case Nos. 20-1458 and 22-1201 to the Court of Appeals for the D.C. Circuit. All other pending motions are denied as moot. [20-1458, 22-1201] (ALW) [Entered: 06/30/2022 01:15 PM] |
