September 7, 2022 JUDGMENT entered by Rogeriee Thompson, Appellate Judge; William J. Kayatta, Jr., Appellate Judge and Gustavo A. Gelpi, Jr., Appellate Judge: Appellant Lori Hall's August 15, 2022, filing, docketed as an "amended petition," is construed as superseding all motions that came before it. In the filing, Hall informs the court that she has "decided to cancel any pending appeals and wait until [c]ase at District Court has been decided." She also informs the court that, in the future, "if [a] decision is unfavorable[,] [she] intend[s] to file [an] appeal in the District Court of Massachusetts." Upon consideration of this filing, it is hereby ordered that this appeal is voluntarily dismissed pursuant to Fed. R. App. P. 42(b), mandate to issue forthwith. This dismissal is without prejudice to appellant's right to appeal a final judgment in the district court. See, e.g., 28 U.S.C. 1291; Fed. R. App. P. 3 & 4. All pending motions, to the extent not mooted by the foregoing, are denied. [22-1607] (ALW) [Entered: 09/07/2022 11:24 AM]
