April 25, 2023 Opinion or Order ORDER entered: Upon consideration, Appellant Kelechi Linardon's motion to waive appellate filing fee is denied without prejudice to re-filing in the district court as a motion to appeal in forma pauperis. Upon review of the present appeal, it appears that the appeal is brought under 28 U.S.C. 1292(a)(1), which allows appeals from "interlocutory orders of the district courts of the United States ... granting, continuing, modifying, refusing or dissolving injunctions." Thus, this case is not an "application for an appeal" brought under 28 U.S.C. 1292(b). As a result, it appears that the filing fee is properly due. In the event that the appellate filing fee represents a hardship to Appellant, she may file a motion before the district court asking for leave to appeal in forma pauperis.
