Gelp , Jr., Appellate Judge: Plaintiffs-appellants have moved to stay this appeal while the Rhode Island Supreme Court is in the process of deciding the case of Josephson, LLC v. Affiliated FM Ins. Co. , SU-2023-0022-A. They assert that this case and Josephson both concern insurance coverage for a claim of property damage, controlled by Rhode Island law, arising from the COVID-19 pandemic and that the ultimate outcome in Josephson may be of significance. See generally Erie R.R. Co. v. Thompkins , 304 U.S. 64 (1938). The parties in this case have not yet filed appellate briefs, and briefing in Josephson is ongoing. Defendant-appellee opposes the motion for a stay, arguing that it is unnecessary and inefficient at this stage of proceedings.
