By order entered August 8, 2023, plaintiff-appellant Tonya Withers was directed to show cause in writing why this appeal should not be dismissed for lack of jurisdiction or to move for voluntary dismissal of this appeal. Appellant was warned that failure to respond by August 22, 2023 would lead to dismissal of this appeal for lack of diligent prosecution. Appellant having failed to file a timely response, it is hereby ordered that the above-captioned appeal be dismissed in accordance with 1st Cir. R. 3.0(b). On July 12, 2023, plaintiff-appellant Tonya Withers filed a notice of interlocutory appeal (D.E. 7) in district court case No. 1:23-cv-00281-SDE (D.R.I.), challenging the chief judge's July 12, 2023 order (D.E. 6) recusing all judges in the District of Rhode Island and referring the matter to the District of New Hampshire for assignment by designation. Upon review, the order appealed from does not appear to be final or appealable on an interlocutory basis, and this court does not appear to have jurisdiction to review this appeal. Accordingly, appellant is ordered to either move for voluntary dismissal of this appeal pursuant to Fed. R. App. P. 42(b), or to show cause, in writing, why this appeal should not be dismissed for lack of jurisdiction.
