Montecalvo, Appellate Judge and Julie Rikelman, Appellate Judge: These two appeals come to us from the same proceeding in the District Court for the District of Puerto Rico. There were two notices of appeal, leading to the opening of Appeal Nos. 23-1612 and 23-1613. The appeals concern the district court's grant of a motion to remand to a Puerto Rico court of first instance, denial of a motion to stay that remand, and subsequent transmittal letter remanding the case to the Puerto Rico court. Now before the court are two motions. First, Defendant-Appellants CaremarkPCS Health, L.L.C., and Caremark Puerto Rico, L.L.C., filed an ". . . Emergency Motion to Stay Pending Appeal," requesting relief by August 30. Then, Defendant-Appellant Express Scripts, Inc., filed a "Motion to Order the Recall of the Remanded Case Pending Appeal." These two motions are framed somewhat differently, but each motion is geared toward having this court halt and/or reverse the remand to Puerto Rico court. After careful review, we conclude that the moving parties have not demonstrated entitlement to the relief sought. See Akebia Therapeutics, Inc. v. Azar , 976 F.3d 86, 92 (1st Cir. 2020) (noting, when evaluating the four stay/injunction factors in the context of a preliminary injunction, that "[i]f the movant fails to demonstrate a likelihood of success on the merits, the remaining elements are of little consequence"); see also Moore v. Elec. Boat Corp. , 25 F.4th 30, 34-38 (1st Cir. 2022) (examining 28 U.S.C. 1442(a)(1) and precedent related thereto); Woo v. Spackman , 988 F.3d 47, 53 (1st Cir. 2021) ("[T]he burden of establishing jurisdiction must fall to the party who asserts it.").
