ORDER entered. This court has docketed this appeal from the denial of appellant's motion to vacate sentence under 28 U.S.C. 2255. The case cannot go forward unless a certificate of appealability issues. 28 U.S.C. 2253. The district court declined to issue a certificate of appealability on August 31, 2023. Appellant was ordered to file a memorandum in support of a certificate of appealability by December 4, 2023. To date, the memorandum has not been received. Accordingly, if appellant does not file a memorandum in support of a certificate of appealability in the above-captioned case by January 11, 2024 , this case will be submitted to this court for a determination whether a certificate of appealability should issue.
