ORDER entered: Petitioner has filed an application for permission to file a second or successive motion to vacate pursuant to 28 U.S.C. 2255. However, petitioner's request is not accompanied by a completed application form or copies of the relevant portions of his federal court proceedings as set forth in 1st Cir. R. 22.1(a). Accordingly, we treat the request for permission to file a second or successive motion to vacate as lodged until petitioner files the enclosed application in this court. 1st Cir. R. 22.1(b). The thirty-day period in which this court must act on petitioner's request shall begin to run from receipt by the clerk's office of the completed application. Petitioner is directed to file, on or before January 16, 2023 , the application and all attachments, with proof of service on all parties to the case through counsel. Failure to timely file the application may result in the automatic denial of permission to file the petition in district court and dismissal of the case without further action.
