ORDER entered by Gustavo A. Gelp , Jr., Appellate Judge; William J. Kayatta, Jr., Appellate Judge and Lara E. Montecalvo, Appellate Judge: Defendant-appellant Olarewaju James Oladipo has filed a motion for release pending appeal. After careful review of the parties' submissions and the relevant portions of the record, we conclude that, with the arguments set out in the bail motion, defendant has not identified any substantial question likely to result in reversal, a new trial, a non-prison sentence, or a reduced prison sentence shorter than time served plus the expected length of the appeal. See 18 U.S.C. 3143(b)(1)(B); see also United States v. Zimny , 857 F.3d 97, 99-101 (1st Cir. 2017) (placing burden on the defendant seeking bail); United States v. Bayko , 774 F.2d 516, 518-23 (1st Cir. 1985) (describing bail standard). Accordingly, defendant's motion for release pending appeal is denied. The matter of sealing also must be addressed. The bail motion and the exhibits thereto were tendered under seal, and the court granted the request to seal those documents without prejudice to later reconsideration by the merits panel. In its response to the bail motion, the government suggests that the court should revisit sealing. Within seven (7) days of entry of this order, defendant should show cause why the motion and the attachments thereto, with the exception of any attachment designated "sealed" in the district court, should not be unsealed. In the event defendant does not file a response, the court shall proceed to unseal relevant filings with the exception of any exhibits that remain under seal in the district court.
