January 22, 2026 Opinion or Order ORDER entered. This court has docketed petitioner-appellant's appeal from the denial of his petition for writ of habeas corpus under 28 U.S.C. 2254. While petitioner did not file a timely notice of appeal from the September 30, 2025, denial, the motion for a certificate of appealability filed on October 6, 2025, indicated petitioner's intent to pursue an appeal. Therefore, the motion for a certificate of appealability is provisionally treated as a timely filed notice of appeal from the September 30, 2025, denial. See Fed. R. App. P. 3(c)(4). The case cannot go forward unless a certificate of appealability issues. 28 U.S.C. 2253. The district court issued a certificate of appealability on December 30, 2025. Accordingly, pursuant to Grant-Chase v. Commissioner , 145 F.3d 431 (1st Cir. 1998), this appeal can go forward on the issues for which the district court granted the certificate.
