Mojica-Rivera's letter-motion dated April 23, 2026. We construe that letter-motion as a motion for reconsideration of the March 24, 2026, order denying appointment of counsel under the Criminal Justice Act. See generally Fed. R. App. P. 27(c). The motion is denied . However, the deadline for appellant to file his opening brief is extended to July 15, 2026. As stated in the March 24 order, should appellant wish to rely on one or more district court filings in lieu of filing a brief(s), he may inform the court, in writing and before the deadline for the filing of his opening brief, of his desire to do so; with any such filing, appellant should identify the filings upon which he wishes to rely with as much specificity as possible. Also as stated in the March 24 order, after appellant files his opening brief, the government may renew its motion for summary disposition, may file a new motion for summary disposition, or may file a response brief. ORDER entered by Lara E. Montecalvo, Appellate Judge: Defendant-Appellant Juan M. Mojica-Rivera seeks review of the district court's denial of his motion for sentencing relief pursuant to 18 U.S.C. 3582(c)(1)(A)(i). Several motions and matters require attention. First, there are two appeals because both appellant and the attorney appointed to represent him before the district court filed a notice of appeal. The appeals may be duplicative; however, for the moment, the appeals will be consolidated, subject to later revisitation. Second, counsel appointed in the district court pursuant to the Criminal Justice Act ("CJA") has moved to withdraw and requests the appointment of new CJA counsel. To the extent formal leave to withdraw is necessary, counsel's motion to withdraw is granted . Further, we conclude that the appointment of new CJA counsel is not in order. Thus, appellant is proceeding pro se in the appeals. Third, the government's motion for summary disposition is denied , without prejudice to later reassertion of the untimeliness defense, as the court wishes to hear from appellant on the merits before ruling. A briefing schedule will be entered in due course. Should appellant wish to rely on one or more district court filings in lieu of filing a brief(s), he may inform the court, in writing and before the deadline for the filing of his opening brief, of his desire to do so; with any such filing, appellant should identify the filings upon which he wishes to rely with as much specificity as possible. After appellant files his opening brief, the government may renew the current motion for summary disposition, may file a new motion for summary disposition, or may file a response brief. Fourth and finally, no Transcript Order Form has been filed in Appeal 26-1004. A blank copy of the Transcript Order Form will be enclosed with appellant's copy of this order.
