June 18, 2026 Opinion or Order ORDER entered by Julie Rikelman, Appellate Judge: Counsel seeks to withdraw from representing defendant in this direct criminal appeal. We have reviewed counsel's motion and relevant parts of the district court record. The motion is denied without prejudice. Counsel is directed once again to attempt to confer with defendant, in writing to his last known address if necessary, and provide defendant with advisement of the risks inherent in proceeding pro se; in the same communication, counsel shall attempt to ascertain how defendant wishes to proceed in this court. Counsel shall also provide defendant with a form for selection of counsel. Within fourteen days of the date of counsel's communication, defendant shall file the form for selection of counsel. If in that document defendant states a preference to proceed pro se or to receive substitute counsel, counsel shall, within ten days of defendant's filing, submit a renewed motion to withdraw. If defendant does not file such a form within the time specified, counsel shall promptly file a renewed motion to withdraw. Defendant is advised that if he takes no action responsive to this court's order, his appeal may be dismissed for lack of prosecution. [26-1559] (GRC) [Entered: 06/18/2026 04:18 PM]
