July 28, 2026 Opinion or Order ORDER entered: Attorney Aaron M. Katz has moved to withdraw as counsel for defendant-appellant Pankaj Merchia. The motion is denied without prejudice to refiling with the supporting documentation required by 1st Cir. R. 46.6(c). Specifically, counsel must file a statement, signed by defendant-appellant , indicating whether defendant-appellant wishes (1) to proceed pro se, (2) to retain new counsel, or (3) to seek court-appointed counsel. A form for selection of counsel is being sent directly to defendant-appellant with a copy of this order. If defendant-appellant wishes to proceed pro se or retain new counsel, any renewed motion shall be filed on or before August 27, 2026 . See 1st Cir. R. 46.6(c) (requiring the motion to be accompanied by either a notice of appearance by replacement counsel or defendant-appellant's affidavit). The renewed motion must also be accompanied by proof of service on defendant-appellant. 1st Cir. R. 46.6(d). If defendant-appellant wishes to apply for appointed counsel, defendant-appellant must, with the assistance of Attorney Katz , (a) file a financial affidavit and move to proceed in forma pauperis ("IFP") in the district court and (b) provide this court with proof of filing on or before August 27, 2026 . If the district court grants appellant IFP status, this court may appoint counsel under the guidelines of the Criminal Justice Act, 18 U.S.C. 3006A. If the district court denies the motion, appellant must file a motion to proceed IFP and financial affidavit in this court. See Fed. R. App. P. 24. Attorney Katz is directed to 1st Cir. R. 46.6(a) , providing that "[a]n attorney who has represented a defendant in a criminal case in the district court will be responsible for representing the defendant on appeal... until the attorney is relieved of such duty by the court of appeals."
