ORDER (Clerk) considering the letter dated 1/17/05 from Aaron Christopher Wheeler. Mr. Wheeler is not an appellant in the appeal and, therefore, as a non-appealing party to a civil action cannot request relief from the Court nor address arguments to the Court why the District Court's decision should be reversed or vacated. Mr. Wheeler requests permission to file an amicus brief, "if the matter [appellant] is appealing pertains to us and the conditions raised in the case in the District Court." The Court cannot entertain such a conditional request for leave to proceed as amicus curiae. Mr. Wheeler must determine whether he wishes to file a motion for leave to proceed as an amicus curiae and, if so, make an unequivocal motion requesting leave to do so within the time specified for filing such a motion by the Federal Rules of Appellate Procedure. Should Mr. Wheeler request leave to proceed as amicus curiae, he must make that request by means of a formal motion. Four copies, one of which being a signed original, must be filed with the Court together with a certification evidencing that a copy of the motion has been served on all parties to the proceedings. In no event would Mr. Wheeler be permitted to file as an amicus curiae on behalf of any individual or entity other than himself since he is not an attorney admitted to the Court's bar, filed.
