ORDER (KRAUSE and RESTREPO, Circuit Judges) Mateo Lopez Abrego has filed a motion to stay his removal pending disposition of this appeal of the District Court's interlocutory order that, inter alia, dismissed for lack of jurisdiction Lopez's application for a preliminary injunction in his habeas case under 28 U.S.C. Section: 2241. Lopez's motion to stay his removal is denied because he has failed to satisfy the standard for a stay. See Nken v. Holder, 556 U.S. 418, 426 (2009). In particular, he has not made a sufficient showing of future merits success. Our conclusion in that regard is solely for the purposes of ruling on Lopez's emergency motion to stay his removal; it is not an adjudication of the merits of the appeal. No action will be taken on the motion to expedite as it is unnecessary. The Clerk will issue a briefing schedule in due course., filed. Panel No.: ELD-011-E. KRAUSE, Authoring Judge.(re-sent nda copy of order with court stamp) (DW) [Entered: 07/03/2019 10:02 AM] |
