Filing 7 ORDER (Clerk) considering the foregoing motion. Insofar as a briefing schedule has yet to issue, no action will be taken on the request for an extension of time to file an informal brief. It is noted that this case will be submitted to a panel of the Court for consideration as to whether a certificate of appealability should issue. It is noted that Appellant has not filed an application for a certificate of appealability as of the date of this Order. If Appellant wishes to file an application for a certificate of appealability, the application must be filed within twenty-one (21) days of the date of this Order. No further extensions will be granted absent extraordinary circumstances. If Appellant does not file an application for a certificate of appealability by the deadline established, Appellant's notice of appeal will be deemed to be such an application and will be submitted by the Clerk of this Court to a panel of the Court for consideration. See Fed. R. App. P. 22(b)(2). To the extent Appellant requests to continue in forma pauperis status, the motion is granted. It is noted that Appellant retained in forma pauperis status from the District Court in this matter. No action will be taken on Appellant's request for leave to proceed on the original record as it is unnecessary. If the Court grants the application for a certificate of appealability, and Appellant is indigent, counsel will be appointed on behalf of the Appellant under the Criminal Justice Act, unless the Court instructs otherwise.
