ORDER (Clerk)The Motion by Appellant to Stay Appeal Pending Outcome of Motion for Alteration or Amendment of Judgment pursuant to Fed. R. Civ. P. 59(e) is granted. The appeal is STAYED pending disposition of the Rule 59(a) motion by the District Court. The parties are directed to file written reports addressing the status of the pending motion on February 27, 2023, and every thirty (30) days thereafter until the motion is decided. The stay will automatically expire upon entry of the order disposing of the Rule 59(e) motion. In light of the stay, Appellants application for certificate of appealability must be filed within 21 days of the date of the District Court order disposing of the Rule 59(e) motion. It should be noted that any party who wishes to challenge the order disposing of the Rule 59(e) motion must file a notice of appeal, or an amended notice of appeal. The notice of appeal or amended notice of appeal must be filed within the time prescribed by Fed. R. App. P. 4(a), measured from the date of entry of the order disposing of the motion.
