Appellant is a prisoner and seeks to proceed in forma pauperis on appeal. Appellant is required to pay the full $605.00 fee in installments regardless of the outcome of the appeal. 28 U.S.C. Section 1915 (b). The Court hereby directs the warden or his or her designee to assess an initial filing fee, when funds are available, of 20% of the greater of (a) the average monthly deposits to the prisoner's account; or (b) the average monthly balance in the prisoner's account for the six-month period immediately preceding the filing of the notice of appeal. The warden, or his or her designee, shall calculate, collect, and forward the initial payment assessed in this order to the United States District Court for the Middle District of Pennsylvania. In each succeeding month when the amount in the prisoner's account exceeds $10.00, the warden, or his or her designee, shall forward payments to the United States District Court for the Middle District of Pennsylvania equaling 20% of the preceding month's income credited to the prisoner's account until the fees are paid. December 10, 2025 Opinion or Order Filing 6 ORDER (Clerk) granting motion to stay appeal pending post-trial motions filed by Appellant Ronald Stockton. The appeal is hereby stayed pending the filing and disposition of Appellant's post-trial motions in the District Court. Appellant must notify this Court upon the filing of any post-trial motion and upon the District Court's entry of a decision disposing of such motion. This stay, however, does not relieve Appellant of the obligation to pay the required docketing and filing fees or, alternatively, to file a motion for leave to proceed in forma pauperis on appeal. Accordingly, within fourteen (14) days from the date of this Order, Appellant must either pay to the district court the entire docketing and filing fee of $605.00 or file a motion for leave to proceed in forma pauperis, along with an addendum to the affidavit in support of the motion for leave to proceed in forma pauperis, a completed form authorizing assessments to be made from his prison account, and a certified prison account statement. Failure to either pay the fees or file the motion to proceed in forma pauperis with the supporting documents within the time stated may result in the dismissal of the appeal without further notice pursuant to Third Circuit LAR 3.3 and Misc. 107.1.
