| JUDGMENT FILED - Robert Schroeder appeals from the judgment dismissing his 42 U.S.C. 1983 action. After Schroeder filed his notice of appeal, the district court entered an order expressing a willingness to consider whether Schroeder should be afforded relief under Federal Rule of Civil Procedure 60(b). We construe the district courts post-judgment order as a request for remand. See Winter v. Cerro Gordo Cnty. Conservation Bd., 925 F.2d 1069, 1073 (8th Cir. 1991). Accordingly, we remand this case and grant leave to the district court to conduct further proceedings as necessary. JAMES B.
