March 2, 2022 JUDGMENT FILED - Having reviewed the Response to the courts show cause order of February 8, 2022, the court remands this case for further proceedings in light of Surety Ins. Co. of Cal. v. Williams, 729 F.2d 581, 582-83 (8th Cir. 1984) and Greater Kansas City Laborers Pension Fund v. Paramount Indus., Inc., 829 F.2d 644, 645-46 (8th Cir. 1987). While Mr. Takuanyi bears a heavy burden of proof, Turner v. B.N.R.R., 771 F.2d 341, 346 (8th Cir. 1985), and while his post-dismissal correspondence, alone, may not have met his burden, no evidentiary hearing has been held. See Harris v. Ark.
