May 24, 2023 JUDGE ORDER: On April 27, 2023, the court appointed Beau Finley to represent John Ways, Jr. in this appeal under the Criminal Justice Act. The court has since received John Ways, Jr.s, May 5, 2023, letter in which he states that he wants to proceed as a pro se litigant but that he considers court appointed counsel Beau Finley to be his assistant. Similarly, in a recent filing, Attorney Beau Finley represented himself as standby counsel. Ways may proceed pro se, or he may accept Beau Finley as his court appointed counsel on appeal. If Ways opts to proceed pro se, the court will terminate Beau Finleys appointment under the Criminal Justice Act. With this understanding, Attorney Beau Finley is directed to inform the court by June 2, 2023, whether John Ways, Jr. wants to proceed with Finley as court appointed counsel, or whether he wants to proceed pro se. The briefing schedule will be held in abeyance pending resolution of the matter of Ways representation.
