| JUDGMENT FILED - Iowa inmate Nersius Artisani appeals the district courts order denying his motions for leave to proceed in forma pauperis, for a preliminary injunction, and for appointment of counsel. We grant Artisani leave to proceed in forma pauperis on appeal, and affirm the denial of his motions for a preliminary injunction and appointment of counsel. We vacate the district courts order denying Artisani leave to proceed in forma pauperis based on the three-strike provision of 28 U.S.C. 1915(g), as two of his prior actions, Hoffert v. Black Hawk Cnty. Jail, No. 6:18-cv-02056-CJW-MAR (N.D. Iowa Mar. 19, 2020) and Hoffert v. Munson, No. 6:13-cv-02052-LRR-JSS (N.D. Iowa Jan. 5, 2015), were dismissed following the adverse grant of summary judgment, and thus did not constitute strikes. Accordingly, he has not accrued three strikes. The full $605 appellate and docketing fees are assessed against the appellant. Appellant will be permitted to pay the fee by installment method contained in 28 U.S.C. sec. 1915(b)(2).
