December 9, 2024 Opinion or Order Filing 3 ORDER FILED. The district courts post-judgment order was entered on the docket on September 12, 2024. Appellants notice of appeal was dated October 19, 2024, and received by the district court on October 28, 2024. Appellants October 19, 2024 notice of appeal states he placed in jail mail a notice of appeal and [has] not received a reply. The district court received a second notice of appeal on December 4, 2024, which appears to be dated October 4, 2024, but does not include a proof of service or other evidence reflecting the date it was given to prison officials for mailing to the court. Accordingly, the record suggests that this court may lack jurisdiction over this appeal because the notice of appeal may not have been filed or delivered to prison officials within 30 days after entry of the district courts September 12, 2024 post-judgment order. See 28 U.S.C. 2107(a); Fed. R. App. P. 4(a)(1)(A), 4(c); United States v. Sadler, 480 F.3d 932, 937 (9th Cir. 2007) (requirement of timely notice of appeal is jurisdictional); Houston v. Lack, 487 U.S. 266, 270 (1988) (notice of appeal deemed filed when it was delivered to prison authorities for forwarding to the court). Because appellant is a pro se prisoner, however, a notice of appeal is deemed filed when it was delivered to prison authorities for forwarding to the court, if appellant complied with the requirements of Federal Rule of Appellate Procedure 4(c)(1). See Houston v. Lack, 487 U.S. 266, 270 (1988). Accordingly, within 21 days after the date of this order, appellant must file with this court a declaration or notarized statement attesting to the date on which a notice of appeal for this action was first deposited in the institutions internal mail system for delivery to the district court, and whether first-class postage was prepaid, or otherwise show cause why this appeal should not be dismissed for lack of jurisdiction. See Fed. R. App. P. 4(c)(1); Douglas v. Noelle, 567 F.3d 1103 (9th Cir. 2009). If possible, appellants response should include a copy of any prior notice of appeal, and appellants mail log for the time he claims the notice of appeal was delivered to prison officials. A response may be filed within 10 days after service of appellants declaration. If appellant does not comply with this order, the Clerk will dismiss this appeal pursuant to Ninth Circuit Rule 42-1.
