ORDER FOR PUBLICATION FILED. (Sidney R. THOMAS, Kim McLane WARDLAW, Anthony D. JOHNSTONE) [SEE ORDER FOR FULL TEXT] Plaintiffs motion for judicial notice is GRANTED. In sum, the district court properly concluded that CNA/NNU has associational standing to pursue an intimidation claim under Section 11(b) of the Voting Rights Act. The Federal Defendants have not carried their burden to show that they likely will be irreparably harmed if we do not grant a stay pending appeal for the four-and-a-half days remaining in the preliminary injunctions term. The existing injunction is properly drawn and narrowly defined. Accordingly, we deny Federal Defendants motion for aa stay pending appeal. MOTION DENIED. [Entered: 10/30/2026 12:42 PM]
